Terms & Conditions

1. Scope and Contracting Party

These Terms & Conditions apply to all contracts concluded between Manuel Rogg, PadLab, Bahnhofstrasse 51C, 5430 Wettingen, Switzerland (hereinafter "PadLab", "we" or "us") and you as the customer through our online shop. Any deviating terms of the customer shall not be recognised unless we expressly agree to their validity in writing.

2. Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer but rather a non-binding online catalogue. When you place an order and complete the checkout process, you submit a binding offer to purchase the configured product.

The purchase contract is not concluded upon submission of the order, but only when we accept your order through an express order confirmation by email.

3. Prices, Customs and Payment

The stated price of EUR 239 per pair is a final price and includes shipping within Europe. As the company is currently below the Swiss VAT registration threshold (annual turnover under CHF 100,000 pursuant to Art. 10(2)(a) of the Swiss VAT Act / MWSTG), no VAT is charged. Swiss buyers pay in CHF (currency conversion handled by Stripe at the current rate).

Important notice regarding customs and import duties: Goods are shipped directly from Thailand to your address in Europe. Please note that customs duties, import VAT or handling fees charged by the carrier may apply upon import into your country. These costs are not included in the purchase price and must be borne by you as the buyer.

Payment is made by credit card via our payment service provider Stripe. We do not store any credit card data on our own systems.

4. Delivery and Shipping

Our kick pads are custom-made unique items, handcrafted to your specific requirements by Twins Special in Thailand. Shipping takes place directly from the manufactory in Thailand to your delivery address.

Delivery typically takes 4 to 6 weeks from the date of order confirmation. Should there be exceptional delays in production or shipping, we will inform you promptly.

5. Exclusion of Right of Withdrawal

No right of withdrawal for custom-made products. Since each pair of kick pads is individually manufactured according to your personal colour selection (body, trim, text), cancellation of the order after receipt of the order confirmation as well as return or exchange due to change of mind is excluded.

Swiss buyers: Under Swiss law there is no statutory right of withdrawal for online orders. Art. 40a of the Swiss Code of Obligations (OR) provides a withdrawal right only for door-to-door and comparable sales, as well as for telephone sales — not for online purchases.

EU buyers: The statutory 14-day right of withdrawal does not apply pursuant to Art. 16(c) of the EU Consumer Rights Directive 2011/83/EU, because the goods are manufactured to individual consumer specifications.

Defective goods will be replaced free of charge under section 6 (Warranty).

6. Warranty and Defect Notification

We guarantee that products are free from material and manufacturing defects. You are asked to inspect the delivered goods promptly upon receipt for obvious defects, transport damage or production errors.

Should the delivered product be defective, please contact us immediately by email (info@padlab.store) with a precise description and clear photographs of the defect. In the event of a justified defect, we will provide a free replacement.

7. Liability

We are liable without limitation for damages caused by intentional or grossly negligent breach of duty on our part. For slight negligence, we are only liable in the event of a breach of material contractual obligations (cardinal obligations), the fulfilment of which is essential for the proper execution of the contract. In this case, liability is limited to the foreseeable damage typical of the contract.

Liability for damages arising from injury to life, body or health, as well as under product liability law, remains unaffected by the above limitations of liability.

8. Data Protection

The collection and processing of your personal data is carried out in strict compliance with applicable data protection laws. For full details, please refer to our Privacy Policy.

9. Applicable Law and Jurisdiction

Contracts between us and you are governed by the substantive law of Switzerland (in particular the Swiss Code of Obligations), excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in the EU, you additionally enjoy the protection of the mandatory consumer protection provisions of your country of residence.

The place of jurisdiction for all disputes is Wettingen, Switzerland. As a consumer, you may alternatively bring claims before the competent court at your place of residence within the EU.

10. Final Provisions

Should individual provisions of these Terms & Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The relevant statutory provisions shall apply in place of the invalid provision.
